Agreement to these terms

These Terms of Service govern your use of Mom's Next Best Home. By creating an account, selecting an acceptance checkbox, purchasing a service, publishing a listing, or otherwise using the platform, you agree to these terms and our privacy policy. If you accept for an organization, you represent that you have authority to bind that organization.

The platform

Mom's Next Best Home provides discovery, listing, communication, lead, and related services connecting families, senior-care communities, and other participants. We do not provide medical, legal, financial, or placement advice and do not guarantee any facility, family, lead, placement, transaction, or outcome. You are responsible for your own evaluation and decisions.

Provider terms

Lead charges and availability

  • Providers are charged for billable leads through metered usage. Lead prices, billing methods, and which lead events are billable may change. The price and material terms presented when the charge is incurred control.
  • A lead is treated as unique for seven days. Additional engagement after that period may be treated and charged as a new lead.
  • Leads placed in a provider's queue remain available for 30 days. A queued lead that is not purchased during that period may expire and be permanently unavailable to that provider.
  • Names, contact details, messages, qualification details, and provider internal notes associated with a lead are scheduled for redaction 24 months after the lead's last activity, unless a documented legal hold applies. Minimal pseudonymized billing, consent, and outcome evidence may be retained for seven years.
  • Lead caps may control when a lead enters the provider's active inbox or queue. Purchasing or releasing a queued lead may create a metered charge.

Listing fees and annual commitment

  • Listing fees are based on the physical resident capacity of each listed facility or unit and the billing option selected. Providers must report capacity accurately and promptly update changes. Current pricing is shown before publication or purchase and may change as permitted by these terms.
  • Listings may be billed monthly or annually, but each paid listing is subject to a one-year contract term. Annual billing may include a discount shown at checkout. Mid-cycle listing additions may be prorated.
  • A listing renews for another one-year term unless cancellation is requested at least six months before its renewal date. A late request takes effect at the following eligible renewal date, and charges through that date remain due.
  • Listing and lead-meter charges are nonrefundable, including unused time, mid-term removal, or a failure to convert a lead, except where required by law or expressly stated in writing by Mom's Next Best Home.

First-listing promotion

An eligible first-time provider may receive a three-month promotional listing period beginning when its first facility is listed, even if that listing is not yet public. It is available only once, has no cash value, cannot be combined or transferred, and may be changed or withdrawn for future participants. Lead usage and other charges may still apply during the promotional period. The offer shown when the first listing is created controls.

Professional photo package

  • Photo and video results vary by facility, access, conditions, scheduling, and creative judgment. The package does not guarantee a specific result or a fixed number of photos.
  • Before accepting the initial delivered package, a provider may request a 50% refund. When the provider selects the refund-and-reshoot option, the provider receives the 50% refund and one replacement photo shoot without an additional provider-facing charge. The provider may not keep, download, publish, or use rejected work.
  • Accepting the delivered assets waives the refund and included redo options. Later reshoots and reshoot orders are nonrefundable. Approved assets may be downloaded and applied to a listing by the provider.

Provider content and conduct

You retain ownership of content you submit. You grant Mom's Next Best Home a worldwide, nonexclusive, royalty-free license to host, copy, format, display, distribute, and promote that content as reasonably needed to operate and market the platform and your listings.

You represent that you own the content or have all permissions needed to provide it; that listing, licensing, capacity, pricing, availability, service, and contact information is accurate; and that the content does not infringe rights, violate law, mislead, discriminate unlawfully, threaten, harass, exploit, or contain obscene, hateful, malicious, or otherwise offensive material. You must safeguard account access and may not scrape, interfere with, reverse engineer, abuse, or use the platform or lead information for unlawful purposes.

Providers may use family lead information only to respond to the selected inquiry and related follow-up requested by that family. Providers may not sell or resell lead information, add a family to unrelated marketing campaigns, or use the information for an unrelated purpose without a separate lawful basis and consent.

Billing and payment

You authorize us and our payment processor to charge the payment method on file for purchases, recurring fees, metered usage, renewals, taxes, and other amounts you approve or incur. You must keep billing details current. Failed or overdue payment may result in restricted access, unpublished listings, collections, or suspension. Except where these terms or applicable law say otherwise, fees are nonrefundable.

Suspension and termination

You may stop using the platform, but contract, cancellation, payment, ownership, license, warranty, liability, and dispute provisions that by their nature should survive will remain in effect. We may remove content or restrict or terminate access for nonpayment, risk, legal requirements, harm to others, or a material or repeated violation of these terms.

Service changes and availability

We may improve, replace, suspend, or discontinue features and may update pricing and these terms. Material changes apply prospectively after notice when required. Continued use after an updated effective date constitutes acceptance, except when law or the updated terms require a new affirmative acceptance.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the platform is provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, merchantability, fitness for a particular purpose, or noninfringement. Mom's Next Best Home is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the platform, leads, listings, participants, or third-party services. Any liability that cannot lawfully be excluded is limited to the amount you paid us during the 12 months before the event giving rise to the claim.
